Wellington, March 20 NZPA - As one legal fight between the country's two supermarket chains appears to be ending in Auckland, another is cranking up in Waikato.

Angela Bull, Foodstuffs property strategy general manager told The New Zealand Herald her company would open a new Pak'n Save supermarket on the North Shore's Wairau Rd in May.

That follows the deadline passing on Wednesday for rival supermarket chain Progressive Enterprises to lodge any further challenges over the store.

In February the High Court dismissed an appeal by Progressive against a 2008 Environment Court decision, which had given the go-ahead to the Wairau Rd supermarket.

Meanwhile, Progressive subsidiary General Distributors has just filed documents in the Court of Appeal seeking permission for a High Court challenge over a proposed Te Awamutu Pak'n Save store which Foodstuffs wants to build.
